User Agreement and Public Offer

This User Agreement and Public Offer defines the terms of use of the website [website address], as well as the procedure for purchasing digital products available on the website.
This document is addressed to an unlimited number of persons and constitutes a public offer. By taking actions to place an order and pay for a product, the user confirms that they have fully read the terms of this document, accepts them without reservation, and undertakes to comply with them.

1. General Provisions
1.1. The seller of digital products on the website [website address] is Dargel Karolina Anatolyevna, an individual engaged in independent professional activity with the application of professional income tax in the Republic of Belarus, hereinafter referred to as the Seller.

1.3. This document is the official offer of the Seller to conclude a sale and purchase agreement for a digital product on the terms set out below.
1.4. A Buyer means any legally capable individual who places an order on the website [website address] and pays for a digital product.
1.5. Acceptance of this offer means placing an order and/or paying for the product by the Buyer. From the moment of acceptance, the agreement between the Seller and the Buyer is deemed concluded.
1.6. The Seller has the right to amend this Agreement without prior notice to Buyers. The new version shall take effect from the moment it is published on the website, unless otherwise stated in the text of the new version.

2. Terms
2.1. Website means the online resource located at [website address], where information about the Seller’s digital products is published.
2.2. Product means digital material presented on the website, including but not limited to electronic files, PDF documents, layouts, instructions, coloring pages, games, educational or entertainment materials in digital format.
2.3. Digital Product means a product provided to the Buyer electronically without the transfer of any physical medium.
2.4. Order means the Buyer’s request to purchase the selected digital product, placed through the website, order form, shopping cart, payment page, messenger, or any other method provided by the Seller.
2.5. Payment means the transfer of funds by the Buyer for the selected product using one of the payment methods available on the website.
2.6. Delivery of a Digital Product means providing the Buyer with access to the paid product by sending a link, file, archive, email, messenger message, or by granting access to a personal account, if such functionality is provided on the website.

3. Subject of the Agreement
3.1. The Seller undertakes to provide the Buyer with the digital product electronically, and the Buyer undertakes to pay for the product under the terms of this Agreement.
3.2. The name, description, price, and other characteristics of the product are indicated on the relevant product page on the website.
3.3. The product is provided exclusively in digital form. Physical delivery, printing, mailing of paper materials, or transfer of the product on a physical medium is not carried out unless otherwise expressly stated on the product page.
3.4. The Buyer understands and agrees that the appearance, color, size, display format, or print quality of the digital product may depend on the Buyer’s device, screen settings, software, printer, paper, and other technical conditions beyond the Seller’s control.

4. Placing an Order
4.1. The Buyer independently selects a product on the website and places an order using an available method.
4.2. When placing an order, the Buyer provides the necessary data, including [list of data collected when placing an order: name, email, phone number, etc.].
4.3. The Buyer is responsible for the accuracy and correctness of the data provided when placing an order. If the Buyer provides an incorrect email address, phone number, or other contact details, the Seller shall not be responsible for the inability to deliver the digital product.
4.4. Before payment, the Buyer must check the selected product, its description, price, and contact details for receiving the product.
4.5. The order is deemed accepted by the Seller after the successful payment for the product by the Buyer, unless another procedure is specified on the website.
4.6. The Seller has the right to refuse to fulfill an order if the product is unavailable, a technical error occurs on the website, payment has not been received, or the Buyer has provided incorrect data.

5. Payment
5.1. The price of the product is indicated on the respective product page and/or payment page in a currency available for payment and permitted under applicable law. The final amount and currency of the payment are displayed to the Buyer before the payment is made.
5.2. Payment for digital products is made online using bank cards through the secure payment system bePaid.
5.3. After clicking the "Buy" button, the Buyer is redirected to a dedicated secure payment page of the bePaid processing system, where the order number and payment amount are specified.
5.4. To complete the payment, the Buyer must enter their bank card details and confirm the payment. If the bank card supports 3-D Secure technology, the Buyer may be required to complete the standard payment verification procedure on the website of the card-issuing bank.
5.5. After successful payment, a payment confirmation and information for accessing the digital product will be sent to the email address provided by the Buyer when placing the order.
5.6. The following bank cards are accepted for payment: Visa, Visa Electron, MasterCard, Maestro, and Belkart.
5.7. Bank card payments are processed through the bePaid electronic payment system (https://bepaid.by/kak-oplatit). The bePaid payment page complies with PCI DSS Level 1 security requirements. Data transmission is carried out in encrypted form using secure SSL/TLS protocols.
5.8. The Buyer’s payment obligation shall be considered fulfilled from the moment the payment system confirms the successful completion of the payment.
5.9. All fees charged by banks, payment systems, telecom operators, or other intermediaries, if applicable, shall be borne by the Buyer unless otherwise specified on the website.
5.9. Refunds shall be made to the bank card originally used for payment within 1 to 30 calendar days from the date the Seller processes the refund.
5.10. The refund policy for digital products is set forth in the relevant section of this User Agreement and public offer.
5.11. The Seller reserves the right to change product prices unilaterally. However, the price of a product already paid for by the Buyer shall not be subject to change.

6. Delivery of the Digital Product
6.1. The product is provided to the Buyer exclusively in digital form.
6.2. Delivery of the product is carried out by one or more of the following methods:
  • sending a file or link to the Buyer’s email address;
  • sending a file or link via messenger;
  • providing a download link after payment;
  • granting access to a personal account on the website;
  • any other method indicated on the product page or agreed with the Buyer.
6.3. Timeframe for providing the digital product: [specify timeframe, for example: automatically immediately after payment / within 24 hours after payment / within 1 business day after payment].
6.4. The product is deemed provided to the Buyer from the moment the file, link, or access is sent to the contact details specified by the Buyer when placing the order.
6.5. If the Buyer has not received the product within the specified period, the Buyer must contact the Seller at homiiwoo@gmail.com or via [contact method]. The Seller shall verify the payment and, upon confirmation of payment, resend the product to the Buyer.
6.6. The Buyer is responsible for ensuring the availability of a device, software, and internet access necessary to download, open, and use the digital product.

7. Rights and Obligations of the Parties
7.1. The Seller undertakes to:
  • provide the Buyer with the paid digital product in the manner and within the timeframe provided for by this Agreement;
  • provide the Buyer with accurate information about the product;
  • provide reasonable technical assistance, if necessary, regarding receipt of the file or link;
  • not transfer the Buyer’s personal data to third parties, except in cases provided for by law or necessary for fulfilling the order.
7.2. The Seller has the right to:
  • change the range, description, and price of products on the website;
  • temporarily restrict access to the website for technical maintenance;
  • refuse to fulfill an order in the absence of payment, in the event of a technical error, inaccurate Buyer data, or another violation of the terms of this Agreement;
  • amend this Agreement by publishing a new version on the website.
7.3. The Buyer undertakes to:
  • read the product description, price, payment terms, and delivery terms before payment;
  • provide correct contact details;
  • pay for the selected product in full;
  • use the product only for personal purposes, unless otherwise expressly agreed with the Seller;
  • not distribute, resell, copy, or transfer the product to third parties without the Seller’s written consent.
7.4. The Buyer has the right to:
  • receive the paid digital product in the manner provided for by this Agreement;
  • contact the Seller if problems arise with receiving the product;
  • receive information about the product before purchasing it;
  • request the correction of a technical error if the product was not provided due to the Seller’s fault.
7.5. A refund for a digital product is possible in cases where the product was not provided to the Buyer due to the Seller’s fault, or if the provided file cannot be opened or used for reasons related to an error on the Seller’s part, and the Seller was unable to resolve the issue by resending the file or providing a correct link.
7.6. No refund shall be made if the digital product was duly provided to the Buyer, and the Buyer’s refusal is due to the product not meeting subjective expectations, the Buyer changing their mind, the Buyer failing to check the product description before payment, or the Buyer not having the necessary technical means to use the product.

8. Intellectual Property
8.1. All rights to digital products, images, texts, layouts, illustrations, designs, instructions, website materials, and other intellectual property objects belong to the Seller and/or other rights holders.
8.2. The Buyer is granted the right to use the purchased digital product exclusively for personal, domestic, family, or other non-commercial purposes, unless otherwise expressly stated on the product page.
8.3. The Buyer is prohibited from doing the following without the Seller’s written consent:
  • copying the product for further distribution;
  • selling, reselling, gifting, or transferring the product to third parties;
  • publishing the product in open access on the Internet, social networks, file-sharing services, messengers, or other sources;
  • modifying the product for subsequent sale or distribution;
  • using the product for commercial purposes;
  • presenting the product as the Buyer’s own work.
8.4. Violation of intellectual property rights entails liability in accordance with the legislation of the Republic of Belarus and the terms of this Agreement.
8.5. The purchase of the product does not mean the transfer of exclusive rights to the product to the Buyer. The Buyer receives only the right to use the product within the limits established by this Agreement.
